BILL 229 – BAN ON COMMERCIAL TENANCY EVICTIONS EXTENDED IN ONTARIO The Ontario Government has passed several pieces of legislation halting or reversing evictions of commercial tenants and protecting them from being locked out or having their assets seized during the COVID-19 pandemic. Most recently, on December 8, 2020, Bill 229, Protect, Support and Recover from COVID-19 Act (Budget Measures), 2020 received Royal Assent and was passed into law by the Ontario Government.
CANCELLED CONDOMINIUM PROJECTS AND TARION DISPUTES In recent years, the cancellation of condominium projects has become a common occurrence in Toronto and the GTA. In 2018, developers cancelled 17 condo projects across the GTA, resulting in the loss of 4,672 units. Cancellations of condo projects occur when a development is slated to be ready for a certain date, would-be buyers sign presale contracts (often selling out the units) and provide a deposit to secure it, and then the developer pulls the plug, sometimes leaving the holders of those presale contracts without their deposit.
MUNICIPAL REGULATION OF BUSINESSES The Municipal Act, 2001 S.O. 2001, c. 25 gives municipalities broad powers to pass bylaws to govern activities within their jurisdiction and establish practices and procedures for the enforcement and prosecution of infractions. Municipalities have fairly expansive powers to regulate a wide range of businesses and business activities.
BANKRUPTCY AND COMMERCIAL TENANCIES: LANDLORD’S RIGHTS As the COVID-19 pandemic endures and a possible second lockdown looms, a consequence that will likely follow is a recession that will bring about a wave of bankruptcies of small and medium size businesses. Although the federal and provincial governments have rolled out the Canada Emergency Commercial Rent Assistance (“CECRA”) to provide businesses commercial rent relief, many have criticized this assistance and other efforts as falling fall short of what is required to save these businesses from bankruptcy.

THE IMPACT OF ONTARIO’S BILL 184 ON RESIDENTIAL TENANCIES On July 22, 2020, Ontario’s emergency declaration expired triggering the end of the province’s pandemic eviction ban. The expiration of the emergency declaration came one day after Ontario’s Bill 184, Protecting Tenants and Strengthening Community Housing Act, 2020 (“Bill 184”) received Royal Assent. This means that as of August 1, 2020, landlords are allowed to evict tenants again.
